The Will of Artsakh Residents Not Taken Into Account: MPs Appeal to the Constitutional Court

Members of the National Assembly from the "Armenia" and "I Have Honor" factions have appealed to the Constitutional Court to challenge a provision of the law that includes a mechanism for transferring the accumulated funds of Artsakh residents to the RA pension system. This was reported by the Human Rights Defender of Artsakh, Gegham Stepanyan. He wrote on his Facebook page:

"Regarding the pension savings of Artsakh residents, I would like to inform that at our request and proposal, one-fifth of the deputies of the RA National Assembly (from the "Armenia" and "I Have Honor" factions) have addressed the RA Constitutional Court concerning the compliance of Article 8.1 of the law 'On Additional Guarantees for the Protection of the Rights and Legal Interests of Participants in the Pension System' with Articles 29 (Right to Property), 60 (Principle of Proportionality), and 79 (Principle of Certainty) of the Constitution.

In other words, they are challenging the provision of the law that was amended by the RA National Assembly in June 2024, which stipulated the mechanism for transferring the accumulated funds of Artsakh residents to the RA pension system without considering their will. The appeal has substantiated the contradiction of this provision with the property rights enshrined in the Constitution. I will provide further information on the progress of the situation."
