The Lawyer of Father Oshiny Has Been Released from Participation in the Proceedings
Lawyer Armine Fanyan writes on her Facebook page: “Today we received an important decision from the Court of Cassation regarding Father Oshiny Hayrapetyan from the Aragatsotn Diocese! I had appealed to the Court of Appeals regarding the decision of the First Instance Court to authorize a search of Father Oshiny's residence. The head of the investigative team, Nazeli Sargsyan, informed Lusine Alaverdyan, who accepted the appeal for consideration, that I have been released from participating in the proceedings due to a conflict of interest with my clients (an obviously false statement presented to the court, as no conflict exists) and claimed that I am not a proper appellant. Lusine Alaverdyan, in order to release me from the appeal, rejected it without discussing the appeal, based on the investigator’s reasoning. I had appealed this court decision to the Court of Cassation, as shortly after filing this appeal, the investigator made a decision to release me from participation in the proceedings; hence, I asserted that I was a proper subject. The Court of Cassation has accepted the aforementioned appeal! Let’s wait for a precedent decision!”
