ECHR Obligates Baku to Provide Information on Those Captured on November 16
The European Court of Human Rights (ECHR) has required Baku to provide information on those captured on November 16 by Monday. This information is reported by 1lurer.am.
Armenia had approached the court on November 22, demanding the protection of the fundamental rights of Armenian military personnel captured during Azerbaijan's aggressive actions in the country's sovereign territory. Azerbaijan was given until December 1 to present detailed information regarding the whereabouts and health status of these individuals.
“Having previous experience, we anticipated that Azerbaijan might not respond or might request more time to answer the questions. On December 1, we received notification from the court that Azerbaijan requested an extension for responses,” said Liparit Drmeyan, head of the Armenian representative's office at the ECHR.
Azerbaijan has requested time until December 8 to provide information to the European Court. The ECHR has partially granted this request from Baku, setting a deadline of December 6.
The Armenian representative's office at the ECHR expects that Azerbaijan will comply with the court's decision, and there will be no need to appeal to the Committee of Ministers. “We hope there will be no need to resort to other mechanisms, and by December 6 we will receive some response from Azerbaijan,” Drmeyan added.
According to international law expert Ara Ghazaryan, by violating the deadlines for complying with ECHR decisions, Azerbaijan is attempting to prolong the matter on a legal level for political purposes. “There is already a formed image against Azerbaijan in both the Committee of Ministers and the European Court regarding non-compliance with decisions. Azerbaijan had not complied with a decision from the ECHR for nearly three years regarding the release of a journalist,” Ghazaryan reminded.
Azerbaijan is required to provide complete information regarding the captives as per the ECHR's demands.
