Unvaccinated or Untested Employees Will Not Be Allowed to Work: Employers Can Withhold Salary

A new draft law has been discussed on the unified platform for the publication of legal acts, proposing amendments to the Labor Code and the Law on Public Service, as reported by factor.am.

According to the legislative changes, employees in both the public sector and private industry will be legally required to present certificates confirming vaccination or testing. If the necessary documents are not provided, the employer will have the right to deny the employee access to work, withhold salary, and even terminate their employment.

The amendments suggested by the Ministry of Labor and Social Affairs stipulate that if an employee fails to present the required certificates, the employer can prevent them from being present at the workplace and performing their job duties. The employer also retains the right to withhold salary until the necessary documents are submitted. Additionally, employers will have the authority to dismiss an employee if they have not performed their job responsibilities for more than 30 consecutive days or more than 50 days within the last twelve months.
