The Key Role of Grigoryan in the Merger of the Constitutional and Supreme Courts
The newspaper "Past" reports: "As is well known, the latest session of the Constitutional Reform Commission took place recently, during which a proposal was made to establish a new Supreme Court in the Armenian legal system. According to the preliminary version, the establishment of this new system should occur through the merger of the Constitutional and Supreme Courts. This topic has drawn the attention of the entire legal community and has sparked wide discussion and sharp criticism.
Experts argue that this is yet another series of decisions taken 'on the fly' by the authorities, as almost no risks have been calculated; moreover, it contains significant latent risks that could 'explode' primarily when appealing decisions. Additionally, it has an evident political bias.
One prevailing opinion was that our judiciary system generally belongs to the Roman-Germanic legal branch, and by forming a Supreme Court, we are being forced into an Anglo-Saxon legal framework.
According to the newspaper’s information, in this process, just like in almost all 'constitutional' issues of the current authorities, the main and key role belongs to Vahe Grigoryan, who is intensively holding meetings with certain commission members on this occasion.
According to the preliminary version, this question will be open for public discussion in the upcoming months. We also have information that parliamentary hearings will take place during the next session of the National Assembly regarding this issue.
At the same time, opinions are being voiced that this process is merely an imitation, and this initiative will remain entirely on paper. This view is based on the fact that the authorities are desperately changing Constitutional Court judges, and if there were a real desire to form a Supreme Court, the process would either not take place or would simply be delayed.
On the other hand, in a conversation with the newspaper, a prominent lawyer expressed the view that this haste is related to resolving issues with a purely political subtext that will please the authorities within the next year through the Constitutional Court, and in this case, the temporary status of new Constitutional Court judges does not interest Pashinyan.
In other words, there are two possibilities: either the authorities will simply use the new Constitutional Court judges temporarily, or the Supreme Court will not be created at all."
