Robert Kocharian's Legal Team Appeals to the Constitutional Court

The legal team of the second President of Armenia, Robert Kocharian, submitted an application to the Constitutional Court on January 8. This was announced by Kocharian's legal team.

“The main subject of the constitutional dispute concerns the provisions of Article 414.2, Part 1, Clause 1 of the Criminal Procedure Code of Armenia, which pertains to the authority of the Court of Cassation to ensure the uniform application of laws and other normative legal acts, which is grounds for accepting the cassation appeal for review.

The said provision does not clarify that the authority of the Court of Cassation does not relate to and cannot relate to ensuring the uniform application of the norms of the Constitution of Armenia, as this matter is regulated by the Constitutional Court. At the same time, law enforcement practice has developed in such a way that the Court of Cassation considers the uniform application of constitutional norms as grounds for accepting the cassation appeal for review and resolves such disputes through its own decisions.

Additionally, the legal team is currently discussing the possibility of appealing to the Constitutional Court on several other issues, information about which will be provided in the near future,” the statement reads.
