The Lawsuit of the Landowner of the Segment of the North-South Project Passing Through Yerevan Has Been Rejected

Auroranews.am was informed by Datalex that the Yerevan City Court of General Jurisdiction, presided over by Judge Nelli Harutyunyan, has rejected the lawsuit of the landowner of the plot located at 34/1 Sherami Street against the Government of the Republic of Armenia regarding the North-South Road.

After examining the facts of the case and evaluating all the evidence presented, the Court concluded based on a comprehensive, complete, and objective investigation of the evidence: “In accordance with the first part of Article 12 of the Law of the Republic of Armenia on the Expropriation of Property for the Purpose of Ensuring Public Interests, if the draft expropriation contract is not signed within three months after being sent to the landowner and property rights holders of the expropriated property, the acquirer is obliged to deposit an amount not less than the compensation determined in accordance with this law into the court or notary deposit account within one month and properly inform the landowner and any known property rights holders about this within three days.”

Furthermore, according to Article 13 of the same law, if the compensation amount is not signed within seven days after the deposit has been made, then the acquirer is obliged to apply to the court regarding the expropriation within a month. In this case, only the amount of compensation can be subject to the court's review.

Auroranews.am reports that the court ruled as follows: “The lawsuit of Arshak Seryozhayi Arshakyan against the Republic of Armenia, represented by the Government of the Republic of Armenia, as well as third parties including the Yerevan City Hall and the ‘Implementation Office of Investment Programs for the Development of Yerevan’ State Non-Commercial Organization, to declare the right of the Republic of Armenia over the property terminated on the basis of refusal to acquire the property rights, restore property rights, and consequently invalidate all legal documents regarding recognizing public interests over the property has been rejected.”
