New Rules for Administrative Appeals: Surbuhie Galyan

The government has approved and sent to the National Assembly a legislative package aimed at amending the Administrative Procedure Code, marking another step towards alleviating the burden on courts and organizing effective judicial proceedings. This was announced by the Minister of Justice, Surbuhie Galyan.

"The package stipulates that appeals submitted for review in the administrative court must be examined in written procedure, and only in cases of a reasoned decision should there be an oral examination of the case. It is also expected that appeals submitted for review will have a specific deadline, namely 6 months, which may be extended only once for 4 months. "

Dear citizens, fully recognizing that we have several issues related to the quality of administration carried out by state and local self-governing bodies, we have provided for a limitation on the right of administrative bodies to file appeals in the case of administrative acts imposing fines of up to 300,000 AMD. This means that state and local self-governing bodies will no longer have the opportunity to submit an appeal when the fine imposed by their administrative act does not exceed 300,000 AMD. This change, on one hand, as I mentioned earlier, will contribute to alleviating the burden on courts and ensuring citizens' right to accessible justice, and on the other hand, will draw the attention of administrative authorities to the proper conduct of administration by increasing their vigilance level," she noted.
