Deadline for Registering Self-Built Structures Announced

The government has approved the draft law amending the Law on Amendments and Changes to the Civil Code, HО-397-N of December 16, 2021, which aims to provide one more opportunity to register existing self-built structures by December 31, 2026, including those belonging to private individuals, the state, and local communities.

For private individuals, a prerequisite is set for the self-built structure to be reflected in the 2021 aerial photographs. However, for self-built structures on plots of land owned by the state or community, an exception is established on the logic that properties owned by the state and community hold universal, public value.

According to the government's justification, there are currently self-built structures that, despite being constructed before the aforementioned legislative changes, have not been registered or legalized within the established timeframe. "Many citizens have been unable to register their self-built structures or partially constructed segments within the set deadlines for various reasons. During the specified periods, many citizens did not manage to present the necessary information and documents, which was due to both objective circumstances and a lack of awareness among citizens," the government communiqué states.

By the relevant directive of the Prime Minister, the Cadastre Committee has been tasked with taking necessary steps to draft a relevant legal act, which will allow for a one-time extension of the registration deadlines for self-built structures, considering that no further extensions will be anticipated once the established deadline(s) expire.
