Prosecutor's Office Investigates Former Director of Public Radio for Forged Legal Documents

During the preliminary investigation of a criminal case being examined by the Main Investigation Department of the RA Investigative Committee, factual data have been collected regarding former Executive Director of the Armenian Public Radio, G. Kh., who, wishing to challenge the legality of the decisions proclaiming A. K. as the winner of the competition for filling the vacant position of Executive Director, aimed to create and present a false legal document in order to be considered a valid reason for missing the deadline to submit a lawsuit.

G. Kh. filed a legal application to the Administrative Court through an attorney, seeking to restore the right to carry out actions related to the missed procedural deadlines. The former executive director justified this application by claiming that he had been unemployed since the moment he learned of the violations of his rights and had no other source of income to afford paid legal services, making it impossible to submit a lawsuit within the established period.

He submitted information regarding his income, asserting that he had not received wages or equivalent payments during that time, while deliberately failing to include the income he did receive in the submitted procedural documents, thereby falsifying said documents.

The fraudulent motion to restore the missed deadlines was approved by the court, and the application was accepted for consideration. The Council of the Public Broadcaster filed an appeal against this decision in the Administrative Court of Appeal; however, G. Kh., continuing with his criminal intent and knowing that the false data he submitted to the Administrative Court could be crucial for the appellate court's examination of the respondent's appeal, did not withdraw his application, leading to falsified documents that excluded his actual income being transferred to the Administrative Court of Appeal.

Moreover, desiring to achieve his ultimate goal, G. Kh. once again filed a motion through an intermediary to the Supreme Court after the Administrative Court of Appeal satisfied the respondent's appeal.

A public criminal prosecution has been initiated against G. Kh. under Article 479, Part 1 of the Criminal Code (forging, altering, destroying, concealing, or presenting false evidence, statements, or procedural documents).

The criminal case has been forwarded with an accusatory conclusion to the supervising prosecutor, with a request for confirmation and transmission to the court for substantive examination.
