It Is Not Mandatory to Link Property of Illegal Origin to Any Crime: Galyan

The Constitutional Court has deemed the law and all its provisions consistent with the Constitution, which means we are dealing with a fully constitutional law and its regulations. At the same time, the Constitutional Court has essentially interpreted the law from the perspective of its objectives and has distinguished two legitimate purposes: one is the fight against crimes, and the other is the fight against corruption. This was stated by the Minister of Justice Srbuhi Galyan in the National Assembly.

“In this context, the court has identified two subject categories: one consists of public officials, while the other comprises physical persons who are not public officials. In these two groups, the purpose is presented in different ways. When we are dealing with public officials, the purposes of combating corruption and preventing corruption are applicable and operational, and in this sense, it is not mandatory to link property of illegal origin owned by public officials to any crime. However, when we are dealing with a physical person who is not a public official, then, in accordance with the principle of balancing probabilities, a specific link between the crime and the acquired property must be substantiated.
