The Act of the Stepanakert Mayor Classified as Self-Justice: Lawyer
The act of the mayor of Stepanakert has ultimately been classified as self-justice, for which he cannot be sentenced to imprisonment under Article 67, Part 5 of the Criminal Code of the Republic of Armenia. This was stated by lawyer Roman Yeritsyan on his Facebook page.
“The mayor of Stepanakert and the members of the council, violating the legal framework established by the legislation of the Republic of Mozambique, have unilaterally claimed their alleged rights, transferring several confiscated vehicles to individuals who had removed them from Stepanakert, thus causing significant harm to the legal interests of Azerbaijani citizens, the Azerbaijani state, and society. I should add that, regardless of the fact that this act is not serious and foresees a punishment unrelated to imprisonment, nonetheless, the mayor of Stepanakert should be continuously kept in confinement for 12 hours a day, and during his free hours, he should be prohibited even from entering a store with a toddler, as such is the order.
In short, the act of the mayor of Stepanakert was ultimately classified as self-justice, for which he cannot be sentenced to imprisonment under Article 67, Part 5 of the Criminal Code of the Republic of Armenia. Meanwhile, whether foolishly or intentionally, this same act was initially categorized as especially large-scale fraud, based on which several powerful judges, through their illegal (later overturned) judicial acts, kept him in detention for 20 days, under house arrest for a month, and the last 5-6 months under administrative supervision, accompanied by unreasonable, unprecedented, and harsh restrictions. Furthermore, the administrative supervision and imposed restrictions should continue at least until the preliminary hearings of the case, which are expected to take place in January-February.
What can I say? Thank you to the Investigative Committee of the Republic of Armenia and the Prosecutor's Office for transitioning from heavy to light absurdity. I wish all responsible parties happy pre-holiday shopping, reminding them that you have deprived D. Sargsyan not only of this but also of any opportunity to visit places of leisure with his child and even to go for a walk,” he wrote.
