Areas of Yerevan's 'Buenos Aires' Park Illegally Sold to Individuals
The Prosecutor's Office of Ajapnyak and Davtashen administrative districts in Yerevan has conducted a study on the procedures for registering ownership rights over state land allocated to the 'Buenos Aires' park in the Ajapnyak district within the framework of their authority to protect state (community) interests.
The investigation revealed that boundaries of the land area designated as the 'Buenos Aires' park, located at the intersection of Margaryan and Halabyan streets, were adjusted by a decision of the Mayor of Yerevan on October 10, 2002. Additionally, addresses 65/6 and 65/4 Halabyan Street were assigned to unauthorized constructions located in a common-use area designated for park paths and lawns.
According to decisions made on January 22, 2008, and May 6, 2009, by the Mayor of Yerevan, specified areas included in the list of non-expropriable territories pursuant to Article 60 of the Land Code were sold to individuals by the municipality officials through direct sale.
Specifically, a structure of 19.5 square meters located at 65/6 Halabyan Street, a land area of 515.89 square meters, as well as a 36.28 square meter structure at 65/4 Halabyan Street and a separately allocated land area of 42.16 square meters, have been sold directly to individuals who constructed the unauthorized buildings.
Given the findings of the investigation which indicated potential criminal offenses, the Prosecutor has reported the matter to the Anti-Corruption Committee. A criminal case has been initiated under Part 1 of Article 308 of the Criminal Code adopted on April 18, 2003 (misuse of official authority).
The Prosecutor's Office is taking measures within the scope of their authority to protect community interests to return the community property to the municipality.
