What Temporary Measures has the International Criminal Court Decided to Implement Against Azerbaijan

The International Criminal Court has announced that it will publish its decision regarding the application of temporary measures in the case of "Armenia vs. Azerbaijan" on November 17, 2023. According to the decision, "The circumstances of the present application by the Republic of Armenia differ from Armenia's other applications, regarding which the Court has issued decisions on the application of temporary measures. There are new circumstances confirming new facts from Armenia's fifth application. The Court considers it justified to determine that, as a result of actions taken on September 19, 2023, Azerbaijan has violated certain rights of ethnic Armenians. The Court thus finds a connection between the rights of ethnically Armenian individuals and the application made by Armenia for the imposition of temporary measures."

The International Criminal Court has decided to implement the following temporary measures:

  • Azerbaijan is obliged to ensure the return of those who have fled from Nagorno-Karabakh.
  • To ensure that those who remain in Nagorno-Karabakh can leave if they wish to.
  • To ensure that individuals who remain in Nagorno-Karabakh after September 19, 2023, or who have returned, are free from the use of force or intimidation that could cause them to leave.
