Azerbaijan Fails to Comply with International Court Decisions, Armenia to Appeal to UN Security Council – Yeghishe Kirakosyan

In an exclusive interview with Sputnik Armenia, Yeghishe Kirakosyan, Armenia's representative on international legal issues, addressed the judicial claims filed by Armenia in international courts, the checkpoint established by Azerbaijan in the Lachin corridor, and the ratification of the Rome Statute.

“The decision of the International Court of Justice, while mandatory, is not being implemented by Azerbaijan. In this case, apart from political assessments and statements, what does this provide for the Armenian side? If Azerbaijan fails to comply with the court's demands, are there any international levers to influence Azerbaijan, aside from making political stance statements?”

“Certainly, political statements do not have an immediate effect on the reopening of the corridor at this moment, and the corridor remains closed and in a more tense situation. However, the enforcement mechanism of the international court is the UN Security Council, where I believe it is essential to raise this issue at this time. According to the UN Charter, the Security Council is the political body empowered to enforce court rulings or monitor their implementation and make decisions based on them.”

“Of course, we are talking here about a provisional measure decision by the court, not about a ruling, which is the final act of the judiciary. But I believe that a similar mechanism can be applied in this case as well. I am confident that similar works are being carried out at this time, and this is the path we should continue to take, regardless of whether we have results at this moment, or whether Azerbaijan complies or does not comply.”

“The effect of the decisions of judicial bodies in international law or international relations is unfortunately such that the implementation of international court rulings is not a perfect mechanism.”
