Prime Minister to Appoint Armenia’s Representative in International Courts: Draft Legislation in Parliament

The draft amendments to the law on the 'Representative in International Legal Matters' will clearly define several powers of the representative, particularly regarding the submission of requests for interim measures to the European Court and the International Court of Justice.

The International Legal Affairs Representative will be able to submit a request for interim measures to the European Court on behalf of Armenia, and will also have the opportunity to submit a motion regarding the securing of claims to the International Court of Justice without a Government decision.

As a result of negotiations surrounding international arbitration or the transfer of disputes to the court, a settlement agreement may be concluded, which must be submitted for Government approval. Lawyers dispatched to international courts, the Department for the Enforcement of European Court Decisions, and international arbitration centers will travel based on a decision made by the Prime Minister.

According to International Legal Affairs Representative Yeghishe Kirakosyan, if the individual is not a public servant, a relevant contract will be signed with them. Kirakosyan noted that until now, the issue had not been clearly regulated, but the process had been carried out based on a Government decision.

Presenting the positive conclusion of the Permanent Committee on State-Legal Affairs of the National Assembly, Arpine Davoyan stated that if the proposed regulatory framework is adopted, the legislatively enshrined powers of the Representative will be more clearly defined, resulting in an improvement in the quality of protection of the Republic of Armenia's interests and the effectiveness of the Representative's activities.
