Discussion in the National Assembly on the termination of Seda Safaryan's powers as a judge of the Constitutional Court
In the ongoing session of the National Assembly's Standing Committee on State and Legal Affairs, the issue of addressing the Constitutional Court regarding the termination of the powers of judge Seda Safaryan is being discussed.
Artsvik Minasyan, the secretary of the 'Armenia' faction, stated that the basis for presenting this draft is the joint application of lawyers Arsen Babayan and Sos Hakobyan.
“The analysis of the facts presented there suggests that Constitutional Court judge Seda Safaryan has violated the incompatibility requirements established for persons elected to that position. Under these circumstances, the National Assembly is authorized to apply to the Constitutional Court with a motion for the termination of the powers of the judge who has violated the incompatibility requirement. In democratic and legal states, it is unacceptable for officials to engage in activities incompatible with their position, especially when it concerns a judge of the Constitutional Court,” said Minasyan.
He emphasized that the facts regarding the engagement of the Constitutional Court judge in entrepreneurial activities and the relevant legal regulations are detailed in the lawyers' application.
The application states that Seda Safaryan has been registered as an individual entrepreneur under the name 'Seda Safaryan Sergey' in the State Register of Legal Entities of the Ministry of Justice of the Republic of Armenia since August 11, 1994. On September 15, 2022, she was elected as a judge of the Constitutional Court by the National Assembly, taking office on December 10.
According to the information available in the state register, this individual entrepreneur was deregistered on January 27, 2023, and there are no further entries in the register regarding the suspension or cessation of the activities of 'Seda Safaryan Sergey'. Thus, according to the records in the state register, Seda Safaryan operated as an individual entrepreneur without interruption from August 11, 1994, to January 27, 2023.
