The Executor Provides Clarification Regarding the Incident in Firdus
The executor, based on Article 43.1 of the Law on Mandatory Enforcement of Judicial Acts, has the right to enter a property owned by the debtor, including through opening the apartment or other building, to carry out enforcement actions. This clarification was issued by the Enforcement Assurance Service.
“In light of inquiries from the media, we inform you that on December 6, 2022, the first instance general jurisdiction court of Yerevan granted an enforcement order, according to which the Enforcement Assurance Service must ensure the entry of an expert/expertise from the 'Expertise Center of the Republic of Armenia' into the building located at Republic 8a, in order to facilitate the ongoing judicial expert examination scheduled for October 13, 2022, under civil case ED/56674/02/2021,” the statement reads.
Enforcement actions have been carried out today at the Republic 8a address to ensure compliance with the specified enforcement order. The actions subject to enforcement based on the order have already been completed.
At the same time, it is necessary to inform that the executor, based on Article 43.1 of the Law on Mandatory Enforcement of Judicial Acts, has the right to enter a property owned by the debtor, including through opening the apartment or other building, for enforcement actions. According to Articles 47-49 of the Law on the Enforcement Assurance Service, in the event of resistance encountered or an attack on the executor while performing official duties, the executor has the right to use physical force and special means, and in the presence of a real threat to his life or health, to use firearms,” the statement indicated.
