Security Dream LLC Appeals to Court Against Government
Security Dream LLC has filed an appeal to the Administrative Court challenging the government's decision to establish the "Police Photo and Video Recording Electronic Systems Management Center" state non-commercial organization.
It should be noted that by the government's decision No. 1091-N, the "Police Photo and Video Recording Electronic Systems Management Center" has been created, terminating the powers of Security Dream LLC.
Security Dream LLC is demanding the Administrative Court to declare the government decision No. 1091-A dated July 14, 2022, invalid. The company submitted its application to the Administrative Court against the government's decision regarding the establishment of the "Police Photo and Video Recording Electronic Systems Management Center" on October 7, 2022, requesting the annulment of the aforementioned decision.
The court rejected the claim on the grounds that the appeal is not subject to examination in court, thus the acceptance of the application should be dismissed based on Article 80, Part 1, Point 1 of the Administrative Procedure Code (APC). According to Article 192, Part 1 of the APC, individuals and legal entities have the right to challenge the applied or applicable sub-legislative normative legal acts that violate or may violate the rights and freedoms of individuals and citizens established by international law norms regarding Chapter 2 of the Constitution, as well as the rights enshrined in the laws of the Republic of Armenia.
Accordingly, individuals and legal entities cannot contest acts that do not relate to their rights and thus cannot violate their rights.
Security Dream LLC has submitted a cassation complaint.
