VIDEO: Court Employee Releases Close Associate of His Brother from Detention with Assistant and Lawyer
The employees of the Economic Security and Anti-Corruption Department of the National Security Service have uncovered cases of abuse of official powers and illegal judicial rulings as a result of effective operational-investigative measures.
The NSS reports that a sufficient combination of evidence has been gathered in the criminal proceedings initiated by the NSS Investigative Department that a state official exercising powers established by law from the general jurisdiction court of Yerevan, being informed about the existence of a judicial decision regarding the application of pre-trial detention as a measure of restraint against a person with close ties to his brother who is charged in a criminal case ongoing at the Investigative Committee, has expressed willingness to illegally act in favor of this person due to group interests.
Specifically, the official has attempted to release him from detention through the issuance of an obviously unjust judicial ruling. To implement his intentions, the official has involved in the commission of the criminal act as accomplices another state official performing governmental functions within the judicial authority, as well as his assistant and a lawyer from the Chamber of Advocates, who provided advice and information, thus aiding in the commission of the alleged serious crime.
As a result, the state official exercising judicial authority has, conditioned by personal ties with the defendant, abused his exclusive powers related to the implementation of justice, using the influence these powers granted him to the detriment of state interests, applying an alternative measure of restraint that posed probable obstacles to the criminal proceedings despite it being established by the decisions of another judge.
During the preliminary investigation, based on factual and legal grounds, charges have been filed against three individuals for crossing governmental and service powers and for rendering an obviously unjust judicial ruling and their accompliceship, with detention chosen as a measure of restraint for all of them. The preliminary investigation into the criminal case continues, with procedural actions and operational-investigative measures undertaken to reveal all circumstances of the case.
At the same time, the Service, considering that actions against the judge within the framework of the criminal proceedings are being conducted with maximum assurance of maintaining the confidentiality of pre-trial criminal proceedings, and respect for the judge's reputation and independence, cannot provide additional information at this stage of the criminal proceedings.
We had previously reported that Judge Arusyak Aleksanyan, whose powers were suspended, has been detained on charges of crossing official powers, and lawyer Erik Aleksanyan has also been detained on charges of assisting a public official in crossing their powers. Shortly afterward, Arusyak Aleksanyan's assistant was also detained.
