«Some Citizens Take Advantage of Legal Gaps»: Gevorg Papoyan

In today’s session, the ruling party discussed the draft amendments and additions to the Law on Administrative Procedure and Administrative Proceedings.

While presenting the draft, co-author Gevorg Papoyan noted that under the current law, citizens have the right to be informed and participate in the administrative proceedings initiated against them. In many cases, this process cannot be carried out without their presence.

According to Papoyan, numerous citizens exploit circumstances that allow them to bypass proceedings, ensuring that they are never notified about them, which results in the failure to carry out necessary administrative actions, ultimately harming society and the state. “The discussion here may not be limited to just penalties; for example, a citizen may construct illegal structures in a school or building yard. When the state decides that these must be dismantled, the citizen realizes they have committed an illegal act, and upon being informed, they will feel compelled to dismantle the structure. Using various means, they attempt to avoid this, resulting in them intentionally not receiving the notification. Therefore, it is proposed that when a physical or legal entity intentionally does not receive the administrative notification to remain uninformed about the proceedings and avoid fulfilling requirements, in such cases, after the notification is published once on the official website, it should be placed on the site, and five days later, the citizen will be considered informed,” said Papoyan.
