Boris Bakhshiyan to Be Released from Custody
The judge of the Syunik Regional Court, Boris Bakhshiyan, will be released as no motion has been filed to extend his detention period. This was stated in response to a written inquiry from hetq.am by the Investigative Department of the National Security Service.
Bakhshiyan was detained on February 7, 2022, for a two-month period, which was subsequently extended by another month, meaning his detention will last until May 7. According to Article 139, Part 1 of the Code of Criminal Procedure, 'if there is a need to extend the period of detention of the accused, the investigator and the prosecutor must, no later than 10 days before the expiration of the detention period, submit a reasoned motion to the court.' In this case, it turns out that April 27 was the last day that the NSS could submit a motion to extend the judge’s detention, which did not occur.
This means that on the day his detention period expires, May 7, after three months in custody, Bakhshiyan will be released.
It should be noted that the judge is accused of unlawfully detaining an individual in one of the cases under his jurisdiction, which has led to serious consequences due to negligence. This refers to Nver Mkrtchyan, the defendant in the case of Kapan Mayor Manvel Paramazyan, who failed to appear at the scheduled court hearing. Mkrtchyan’s defense attorney sent a letter to the court prior to the hearing, stating that he could not attend the hearing due to an urgent investigative action, and that his client did not wish to participate without him.
