Health Minister's Order is Not Law and Contradicts the Constitution, Lawyer Says
Lawyer Levon Baghdasaryan has issued a statement in which he specifically mentions the following:
“Since January 22, restrictions have been in place in public catering, cultural, and similar establishments for individuals who are unvaccinated or do not have negative test results.
According to the main laws and the Constitution, the right of individuals to movement can only be restricted by law. The Health Minister's order is not a law and contradicts the Constitution; thus, according to constitutional authority, if legal acts contradict the Constitution, the constitutional norm prevails.
Under the Civil Code of the Republic of Armenia, the legislator allows individuals, both natural and legal persons, to defend themselves against both illegal legal acts and illegal actions. If the Armenian government believes that individuals' movement should be restricted, it must regulate this by law, rather than through the individual legal act of the minister,” the statement reads.
