What to Do When Your Employer Urges You Not to Report to Work Without a PCR Test or Vaccination, Lawyer Says

If you report to work without being vaccinated and without a negative PCR test, your employer has no right to terminate your employment.

This was stated by lawyer Robert Hayrapetyan on his Facebook page: “What to do starting October 1, when your employer has urged you not to come to work if you do not have a negative PCR test result or are not vaccinated. Make sure to report to work and demand a written justification if you are being barred from entering the workplace. If you arrive at work without being vaccinated and without a negative PCR test, the employer has no right to terminate your employment.

However, if you do not show up for work based on a verbal instruction or recommendation, the employer may be able to terminate your employment contract for unwarranted reasons on the grounds of the employee's absence from work throughout the entire working day (shift).

Remember, no one, especially under a ministerial directive, has the right to force you to get vaccinated. You can only be vaccinated by your own will,” the lawyer wrote.
