From Now On, Article 300.1 of the Criminal Code is No Longer Part of the Legal System of Armenia: Meloyan
The infamy of the past three years of regime change is summarized by the revelation and/or confirmation of lies and myths. Constitutional expert Gohar Meloyan wrote this on her Facebook page, referring to today’s decision by the Constitutional Court, which declared Article 301.1 unconstitutional.
The following is the post: “Thus, the Constitutional Court confirmed that Article 301.1 of the Criminal Code of the Republic of Armenia (overthrowing the constitutional order) is unconstitutional and contradicts the principles of legal certainty and proportionality. This implies that from now on, Article 301.1 of the Criminal Code of Armenia is no longer part of the legal system of the Republic of Armenia, and criminal prosecutions initiated under this article, and other related restrictions, such as preventive measures, are subject to immediate cessation and removal.”
The overwhelming objective majority of the Armenian legal community has insisted and substantiated this position over the past three years, yet the current ruling force has tried in every possible way to prevent and delay the consideration of this issue in the Constitutional Court.
Let us not forget the persecution of the dignified judges of the Constitutional Court, who have crossed several red lines, including the infamous unconstitutional constitutional changes carried out in one day.
It is regrettable to note that the legal position of the Constitutional Court evidently aligns with the interests of the current ruling force, considering how many times they have blatantly undermined the constitutional order of Armenia in the past two years.
