Onik Gasparyan Files Multiple Lawsuits Without Waiting
Following his dismissal from the position of Chief of General Staff of the Armed Forces of Armenia, Onik Gasparyan, as he announced, approached the Administrative Court. According to the Datalex judicial information system, between March 10 and March 17, three lawsuits were filed in the name of Onik Gasparyan in the Administrative Court.
The first lawsuit presented to the Administrative Court, case VD/2029/05/21, was recognized as null and returned by Judge Mher Poghosyan. The second lawsuit submitted to the Administrative Court, case VD/2014/05/21, was recognized as a lawsuit for recognition and was returned, replaced by another lawsuit seeking recognition of the absence of legal relationship, within which the claim for assurance was granted. The third lawsuit filed with the Administrative Court, case VD/2267/05/21, pertains to the recognition of nullity, which has already been assigned to Judge Liana Oniki Hakobyan.
In just one week, the three court cases filed in the name of Onik Gasparyan indicate that he is fully aware that he has been dismissed from his position as Chief of General Staff by legal force, but is constantly seeking ways to navigate the current situation. However, at the same time, Onik Gasparyan further complicates the situation, as the decisions made by the judges of the Administrative Court cannot contradict each other. This evidence shows that Onik Gasparyan and his legal representatives understand that there has been no suspension of the process regarding his dismissal from the position of Chief of the General Staff of the Armed Forces of Armenia and that the assurance of the lawsuit does not restore Gasparyan to his position, which is why they are attempting to find solutions by submitting new lawsuits.
