Strenuous Fight in Case Culminates in Victory: 45 Million Drams to be Paid to State Budget, Tigran Atanesyan
Lawyer Tigran Atanesyan writes: “Two years ago, Soros-LGBT media outlets raised a huge outcry regarding the mansion owned by the family of General Vladimir Gasparyan: inspired by the Nikol Pashinyan's revolutionary entourage, a character filed a lawsuit demanding a huge sum of money. Interestingly, the lawsuit was not submitted in the usual manner. Instead, it was an amendment to another case. The initial lawsuit had nothing to do with V. Gasparyan, and as legal experts know, a claim can be amended as long as its essence does not change. However, this did not prevent Judge A. Mkrtchyan of the Yerevan Court of General Jurisdiction from first allowing the amendment and then separating it into a separate civil case. In other words, the judge effectively 'created' a new case, avoiding the electronic distribution system for cases. Yet, the authors of this idea forgot that the claim was beyond the statute of limitations. After my motion, instead of dismissing the lawsuit, the claimant again amended it, again improperly, as it had no relation to the previous amended claim. The judge, of course, refused my motions for self-recusal, and then twice turned to the Attorney General demanding my criminal liability, as well as filing similar requests to the Bar Association requiring disciplinary action against me. The investigative bodies declined to initiate criminal proceedings twice; nevertheless, the Bar punished me. The judge issued a disgraceful ruling ordering the confiscation of an amount plucked from the air from V. Gasparyan. Nonetheless, the majority of the appellate court, holding high honor, completely overturned the ruling, and the claim was rejected. Today, I received the Supreme Court's decision, which refused to accept the plaintiff's appeal. The strenuous fight in this case culminated in victory, and the claimant, inspired by the entourage, must pay 45 million drams to the state budget as a state duty.
