Hayrapetyan Questions Government on Rector Election Results

Ruben Hayrapetyan, the former acting rector of the Armenian State University of Economics, has directed several questions to the Government through his Facebook page. He notably stated:

“Dear Government, since the issue of confirming the results of the rector election of the ASUE was secretly included in the agenda of the Government meeting only 15 minutes before the start of the session for unknown reasons and was subsequently removed from the agenda to discuss legal issues and related lawsuits further, and considering that according to the current law, the Government of Armenia is authorized to both confirm and annul the election results, I request that the following important questions be clarified and presented during the discussion:

  1. Under what conditions and at whose initiative was the question concerning lawsuits and the court's decision regarding actual illegality included in the Government's agenda as a non-reportable issue, when there has never been a single case in Armenian history where the results of a rector election were confirmed without being reported, including a similar issue just a week ago regarding the confirmation of the results of the rector election of YSU, which was also reported?
  2. Under what conditions and at whose initiative was this unprecedented non-reportable question included on the agenda in urgent mode, just minutes before the meeting, whereas the question that has been prolonged for 5 months could have been included in the agenda of the Government's next meeting in a regular manner?
  3. Why and how is the Government of Armenia confirming a process's results instead of annulling them, being previously informed that the Court of Appeal has explicitly recorded in two separate and active decisions (ED 19554/02/20 and ED 19625/02/20) that this process occurred due to violations of the law, and that if there had not been legal violations, that election simply would not have taken place?
  4. Why and how is the Government of Armenia confirming the results of the rector election, knowing that the chairman of the council, who according to the law "calls the council meeting and ensures the participation of council members", officially declared that he could not physically notify members of the meeting in accordance with the law and ensure the participation of all members, because the decision to lift the ban was received just 5 minutes before the meeting? Furthermore, some council members who were absent have officially stated that they could not attend the rector election meeting because they were not notified about it, evidenced by correspondence indicating that their last notification as council members was the day before the competition, regarding the fact that the competition's ban was still in effect. After that, no notifications were sent by any means indicating that the ban had been lifted and that council members were invited to the meeting.
  5. For what cases has the legislator endowed the Government with the right to annul election results, if not in cases where there are irrefutable facts as mentioned above, and the Government is already informed about them and realizes that confirming the results and that the rector’s actual tenure will lead to issues regarding null contracts and reimbursement of several hundred million drams shortly after another court decision?
