Yerevan News: "Mandate" Relationships Take Interesting Turn as Court Accepts LHK's Appeal
The "mandate" relationships involving Armenia's LHK-Arman Babajanyan are taking an intriguing turn. The Administrative Court has accepted LHK's appeal regarding the case of "returning Arman Babajanyan's mandate to them." We previously reported that LHK had appealed to the Administrative Court against the decision made by the CEC.
It should be noted that the CEC had refused to restore the mandate that belonged to Arman Babajanyan, who left the LHK. LHK believes that the legal process has been violated, as currently, one-third of the parliamentary mandates do not belong to opposition factions, and it is within the CEC's jurisdiction to restore this.
Following this, LHK decided to challenge the CEC's decision. The faction had filed a lawsuit in the Administrative Court, but it was rejected on the grounds that the faction did not possess the right to act as a claimant, as only legal entities or individuals can file an administrative lawsuit, and the faction is neither.
Therefore, they appealed to the Court of Appeal to obtain a precedent-setting decision that would affirm the faction's right to make an appeal. The acceptance of the lawsuit has generated significant excitement in LHK, indicating that it is lawful, and they are likely to receive a precedent-setting decision that could also allow them to challenge the CEC's ruling.
