Former Members of the Constitutional Court Have No Right to Access the Court's Administrative Building, Says MP Nikolay Baghdasaryan

MP Nikolay Baghdasaryan from the 'My Step' faction of the Armenian National Assembly writes on his page: "What is unclear? Based on the amendments made to Article 213 of the Constitution of the Republic of Armenia, adopted by the National Assembly on June 22, 2020, and coming into force on June 26, 2020, the terms of office of a member of the Constitutional Court (judge) appointed until the enforcement of Chapter 7 of the Constitution and who has served for a total duration of at least 12 years are considered to be finished, and the service is terminated.

According to the logic of the direct applicability of constitutional norms, we note that if a member of the Constitutional Court or a judge has reached the total term of at least 12 years in that position, the powers of the Constitutional Court member (judge) are considered to be terminated. A systematic analysis of the norm allows us to state that former members of the Constitutional Court have no right to access the administrative building of the Constitutional Court. Issues related to the pass regime within the building of the Constitutional Court are regulated by the 3rd annex of the operating procedure of the Constitutional Court.
