Former Members of the Constitutional Court Have No Right to Enter the Court's Administrative Building, Police State

The police have clarified an incident involving Constitutional Court judge Hrant Nazaryan. Today, the judge attempted to enter the Constitutional Court building but was denied entry by the police.

The clarification states: “Based on the amendments made to Article 213 of the Constitution of the Republic of Armenia, adopted by the National Assembly on June 22, 2020, and effective from June 26, 2020, the term of authority of a Constitutional Court member or judge appointed before the entry into force of Chapter 7 of the Constitution, who has served as a Constitutional Court member (judge) for a total of not less than 12 years, is considered to have expired, and their tenure ceases.”

“Following the logic of the direct applicability of constitutional norms, we note that if the total duration of service as a Constitutional Court member or judge has reached not less than 12 years, then the authorities of the Constitutional Court member (judge) are considered to have ceased. Systematic analysis of the norm allows us to state that former members of the Constitutional Court do not have the right to enter the administrative building of the Constitutional Court. Issues related to access control at the Constitutional Court are regulated by Appendix 3 of the Court’s procedures.”
