Nazik Amiryan's Lawyer Filed a Recusal Motion Against the Judge
In the Central and Norq-Marash court of general jurisdiction in Yerevan, under the chairmanship of Judge Mnatsakan Martirosyan, the court session on the case of Nazik Amiryan, president of the National Federation of Diving of Armenia and wife of Manvel Grigoryan, continues.
Amiryan's lawyer, Gurgen Grigoryan, submitted a recusal motion against Judge Martirosyan. According to Grigoryan, the basis for the motion is that after separating Amiryan's case from Manvel Grigoryan's case, Martirosyan immediately scheduled a hearing, which raises doubts about the judge's impartiality.
The lawyer stated that the scheduling of hearings is handled electronically, but Martirosyan already knew he would be presiding over the hearing, which led to the assumption that there was a human factor involved in the scheduling process.
In response, Judge Martirosyan noted that if another case is separated from a case presided over by a judge, it does not go for reassignment to other judges but continues to remain under the same judge’s jurisdiction.
However, the lawyer countered that there was no hearing assigned to Martirosyan on the date indicated in the 'Datalex' system, and the judge was not in an appropriate court, and Nazik Amiryan's case was not under his jurisdiction.
Nazik Amiryan also stated that she has doubts about the potential human factor in the assignment process.
Prosecutor Vahe Dolmazyan opposed the motion, stating that the grounds for recusal were absent. The judge then went to the consultation room. The decision will be announced at 16:30.
According to the announcement posted in the 'Datalex' system, Amiryan is accused of illegally acquiring, transferring, and possessing firearms, military ammunition, and explosives in three houses owned by her, in conspiracy with her husband Manvel Grigoryan, their son Arman Grigoryan, and other unidentified individuals, in violation of the restrictions set forth in the RA Law on Weapons, as well as committing various types of thefts.
