Kocharian's Lawyer Appeals to the Minister of Justice

Robert Kocharian's lawyer has appealed to the Minister of Justice regarding the disciplinary accountability of judge Armen Danielyan.

Aram Vardevanyan, the representative and lawyer of the second President of Armenia, Robert Kocharian, has submitted a report to Justice Minister Rustam Badasyan concerning a disciplinary violation by Court of Appeals Judge Armen Danielyan, requesting actions be taken to initiate disciplinary proceedings against him.

It is worth recalling that on June 25, 2019, Judge Armen Danielyan annulled the decision of the first instance court, revoking the personal guarantee imposed on Robert Kocharian as a preventive measure and applying detention instead. On the same day, Judge A. Danielyan made another ruling that annulled the first instance court's decision on “the appeal to the Constitutional Court and the suspension of the case.”

According to lawyer A. Vardevanyan, Judge A. Danielyan issued these decisions with gross violations of material and procedural law, in particular breaching the right to a fair trial as enshrined in the ECHR Convention. The presiding judge repeatedly denied the defense the opportunity to present its position, depriving them of their right to speak, which is unprecedented in judicial practice, especially in the context of detention hearings. The lawyer of R. Kocharian also drew the Minister of Justice's attention to Judge A. Danielyan's biased behavior.
