The 2018 Amnesty Act Will Be in Force: Why Arsen Babayan Could Not Have Been Imprisoned

The former Human Rights Defender of the Republic of Artsakh, Ruben Melikyan, writes on his Facebook page:
'Another political prisoner has appeared in Armenia – the 'dangerous criminal' Arsen Babayan. Behind the legal jargon of the alleged crime attributed to him under Article 314 of the RA Criminal Code, the 'naked eye' fails to notice a crucial circumstance: he has been arrested for a crime for which an individual can NEVER be subjected to imprisonment, even if convicted by the court. Why? Because in all cases, the 2018 Amnesty Act will be in effect.
So, in this situation, can the individual be legally arrested? Of course not. And in these circumstances, can there be reasonable doubt that the true purpose of the arrest is to increase the 'dose' of pressure on Hrayr Tovmasyan and coerce him into giving testimony against him? I believe the answer to this question is also obvious.'
