Constitutional Court's Decision Provides Absolutely Nothing Legal to Kocharyan: Armen Danielyan
The former Deputy Attorney General of Armenia, Armen Danielyan, stated on his Facebook page, "The decision made by the Constitutional Court provides absolutely nothing legal to Robert Kocharyan..."
"At the time of committing the crime in 2008, Kocharyan was not enjoying the immunity provided by the Constitution. The Constitutional Court has recognized Article 135 of the Criminal Procedure Code as compliant with the Constitution, which states that 'Detention and other alternative measures of restraint against the accused may only be applied for such crimes where the maximum sentence of imprisonment exceeds one year, or there are sufficient grounds to assume that the accused may commit actions provided for in the first part of this article.'"
"Moreover, the same Code's Article 35, which establishes the grounds for cessation of criminal prosecution and termination of proceedings, has been recognized by the Constitutional Court as unconstitutional because it does not provide regulations regarding the immunity of persons endowed with special protective measures. In other words, the Constitutional Court believes that provisions should be established in Article 35 of the Criminal Procedure Code regarding the impossibility of criminal prosecution for individuals endowed with immunity when it comes to such individuals."
