Bail Motion Submitted Not Being Reviewed for Over Ten Days, Orbelyan

The defense attorney of Armenia's second president Robert Kocharyan, Aram Orbelyan, stated in an interview with Tert.am that their bail motion submitted on June 27 has not yet been reviewed.

“Our Constitution stipulates the following: if a person's freedom is restricted, they have the right to have the case reviewed and to appeal the decision. When we talk about the issue of detention being reviewed by the court, it includes two components: one is whether to detain or not, and the other is applying an alternative to detention, that is, bail,” he said.

Orbelyan noted that these three issues are part of the same package, but when the detention decision is sent to the Court of Appeals, and the court of first instance has not yet reviewed the bail issue, the Court of Appeals, according to current legislation, does not have the authority to discuss the bail matter.

“It turns out that we have submitted a bail motion that has not been reviewed for over ten days, which is the second instance of this happening. The reason for not addressing it is said to be procedural rules,” he added.
