Vahe Grigoryan Bypasses Article 213: Lawyer Says

The newspaper "Hraparak" reports: "After being elected as a judge of the Constitutional Court, Vahe Grigoryan, while assuming his duties as a judge, stated in the oath text that he would become the second judge of the CCC.
"'From the moment of taking the oath, there will be two judges in the CCC. Upon entering the CCC as the sole judge, since the other judge is currently not in the country, I will inform the public and the authorities about this matter in an acceptable format, after discussing the issue with the members of the CCC, with their consent or in case of absence of consent,' said Vahe Grigoryan.
Grigoryan's statement is viewed as ambitious yet puzzling among legal experts.
Lawyer and international law expert Ara Ghazaryan mentioned in a conversation with us that even if the majority of the population stands up and says they do not want Hrayr Tovmasyan to see the presidency of the CCC, the law must prevail.
"The law should be accepted as a rule. That rule is Article 213 of the Constitution. According to this article, 'The President of the Constitutional Court and the members appointed before the entry into force of Chapter 7 of the Constitution shall continue to hold office until the expiration of their powers established by the Constitution, as amended in 2005. After the entry into force of Chapter 7 of the Constitution, the vacancies for judges of the Constitutional Court shall be filled in succession by the President of the Republic, the General Assembly of Judges, and the Government.'
Article 213 cannot be bypassed. If Article 213 is bypassed, it means that the supremacy of law is not respected. Now Vahe Grigoryan declares himself the president of the CCC, says that the CCC members are illegitimate because they are not judges – all of this bypasses Article 213."
