Driver Dismissed for Gross Violation: Mesrop Minasyan
A driver who transported passengers in the opposite direction on Saralanj Street in Yerevan, which is one-way, has been dismissed for gross violation. This opinion was expressed by Mesrop Minasyan, the responsible person for the Facebook group 'Road Police and Red Lines.'
In the post, it is stated:
“Dear group members, today the Yerevan Municipality released a statement stating that based on the video I shared on December 24, the driver of the bus was dismissed by the director of Yerevan Bus LLC on December 25.”
“For the sake of justice, I must say the following:
The order for the dismissal of the driver by Yerevan Bus LLC, referring to Articles 113 and 120 of the Labor Code, was carried out in gross violation of the law. By justifying the order with these articles, the municipality claims that the dismissal of the employment contract is related to the employee's inability to fulfill his work duties due to insufficient professional skills or health conditions.”
“I should note that this driver has been held administratively accountable by the Road Police and fined for his actions, but if, according to Yerevan Bus LLC, the driver lacked professional experience or did not fit the job, then on what basis was he accepted for employment?”
“Moreover, according to the legal provisions mentioned in the order, the employee should only be dismissed if the employer had notified the employee in writing 35 days in advance.”
“It turns out that the individual is being penalized by the Road Police for his actions, and yet he is dismissed by Yerevan Bus LLC in gross violation of the law. In this case, I demand that other individuals at Yerevan Bus LLC who lack professional knowledge also be dismissed, including the company director, chief accountant, and the head of the transport department in Yerevan, who incorrectly assessed the professional qualifications of this individual, leading to his hiring, and then dismissed him without the required 35-day notice.
