Judge Convicts Innocent Man: Lawyer Presents Video in David Hambardzumyan Case
A video has emerged as evidence in the criminal case of David Hambardzumyan, showing that Judge Zhora Chichoyan convicted an innocent man and imposed a sentence that, according to judicial practice, has never been recorded before. Attorney Gayane Papoyan shared this information on her Facebook page.
"In the video, from 00:00 to 00:02, it is clear that David Hambardzumyan is initially not part of the group of individuals arguing; rather, he walks from left to right to the scene of the conflict. At 00:03 to 00:05, the victims in this case, Abraham Injigulyan (wearing a red and black top) and Ara Poghosyan (dressed entirely in black), are depicted. Throughout this entire duration, David Hambardzumyan does not engage in any actions; he does not strike, insult, or push anyone. His behavior indicates that he is trying to understand what is happening. David Hambardzumyan is at least 3-4 meters away from the victims, with several rows of individuals standing between him and them.
Then, after Ara Poghosyan delivers the first blow, a heated argument and scuffle ensue between the victims and unidentified individuals, with suspected blows being exchanged. This is essentially the moment when the victims are subjected to beating. David Hambardzumyan does not intervene or participate in these events during this timeframe. The preceding footage shows the camera directed at the windshield of a vehicle from which the recording is made, capturing events occurring directly in front of the vehicle, where it is evident that David Hambardzumyan is approximately 5-6 meters away from the vehicle.
At 00:14, the camera shifts to the right, filming the events happening near the right door of the vehicle, where the victim Abraham Injigulyan is visible. Between 00:14 and 00:22, various individuals appear in the camera's field of view, none of whom are David Hambardzumyan. At 00:22, a police officer enters the frame from the direction where David and Gor Hambardzumyan had been standing. By 00:16, the argument, scuffle, and fight between the victims and unidentified individuals are already over, with just yelling audible from different sides. Therefore, the beating that was described in the indictment lasted merely 10 seconds. Between 00:20 and 00:22, one can clearly hear shouts of "Bring them back, bring them back, man," referring to the release of detained individuals, directed at the police officers.
At 00:32, another police officer is seen in the frame, during which they are pushing the victims away towards the back of the vehicle. From 00:32 to 00:33, a sound resembling a gunshot is heard. Notably, at that moment, the camera angle clearly shows the right mirror of the vehicle from which the footage is recorded. It can be seen in the mirror that immediately after the sound of the explosion, a large amount of smoke arises from the back of the vehicle. This indicates that it was not a gunshot, but rather a special measure applied by the police or a noise from a malfunctioning exhaust, creating an explosion sound and smoke. This coincides with the testimony of victim Ara Poghosyan, who stated that there had been no gunshot at that moment, but rather an explosion that resulted in his shoes being torn apart.
At 00:36, a third police officer enters the frame. At 00:38, a fourth police officer appears, calmly holding a mobile phone. At 00:48, victims Abraham Injigulyan and Ara Poghosyan are depicted. Since 00:14, they have been positioned towards the back on the right side of the vehicle from where the recording is made, meaning they are not where David and Gor Hambardzumyan were located. At 00:51, the victims turn and walk towards those individuals they were previously arguing with; it is clear that none of them strikes anyone during this time, instead trying to calm the situation.
According to the video, the actual argument and scuffle completely end at 00:14.
In this context, how can we not proclaim that David Hambardzumyan is a political prisoner? Everything is very evident and straightforward. Just one thing is overlooked: no one can escape God's judgment. Sending an innocent father of four to prison cannot be acceptable—morally or legally. This is yet another nonsense aimed at isolating David from political processes," she wrote.
