Court Rejects New Indictments Proposed by Prosecutor in Case of Robert Kocharyan and Others
The Anti-Corruption Court, presided over by Judge Sargis Petrosyan, decided to allow a change solely in the legal assessment of the actions in the case of Robert Kocharyan and others.
The court examined the public prosecutor's motions regarding changing the legal qualification of the actions and introducing new charges, which, according to the Constitutional Court of Armenia, the Court of Cassation, and the Criminal Procedure Code of Armenia, could only involve a modification of the legal assessment.
However, it should be noted that the Prosecutor's Office had unlawfully submitted the charges by altering the factual description, which the Court did not accept, granting the public prosecutor a reasonable timeframe to remedy the violations recorded within the specified period.
