Functional Assessment Process to Be Recorded on Video
The Ministry of Labor and Social Affairs proposes to make additions and changes to the laws on the "Rights of Persons with Disabilities," the "Assessment of Individual Functionality," and the Civil Code.
It is proposed to amend points 17 and 18 of the first part of Article 3 of the "Rights of Persons with Disabilities" law. The purpose is to create a legal basis for the possibility of receiving compensation from donor organizations other than the state budget for the provision or repair of supportive measures, including alternative (non-state) sources of funding.
Furthermore, the concept of the "independent living center" will be enshrined at the legislative level, and the scope of competent bodies authorized to provide personal assistant services will be expanded. As reported by "Fact" newspaper.
It is also proposed to record the state’s obligation in the law to ensure accessible services and to establish clear criteria and technical requirements necessary for the provision of services, particularly in banks, their branches, and credit organizations.
With the amendment to the law on "Assessment of Individual Functionality," individuals who have undergone a functionality assessment and have an existing decision on their assessment will not need to undergo another assessment for new services. Instead, changes will only be made in individual service plans.
The introduction of video recording of the functionality assessment process is intended to ensure transparency, enhance the quality of assessments, and efficiently regulate disputes and complaints.
There will also be the possibility of transferring the data of the information database to organizations cooperating with the authorized body, in accordance with established procedures, for the purpose of conducting statistical and research work, as well as evaluating program effectiveness, while maintaining the confidentiality of personal data.
