A Self-Built Structure Legalized in Yerevan by Mayor's Decision
The Mayor of Yerevan, Tigran Avinyan, has signed a decision, which we present in full below.
“Based on the administrative court's ruling dated August 9, 2022, file number VD/0799/05/22, the preservation of the self-built structure located at 27/2 Gulbenkian Street does not violate the rights of others and the legally protected interests. It does not pose a threat to the life and health of citizens, considering that the self-built structure was not constructed in the expropriation and safety zones of engineering and transport facilities and does not significantly violate urban planning norms and rules. It does not create the right to demand an enforced servitude, and also taking into account that the self-built structure complies with the conditions of the projects of structures located in the established state or community significance urban planning complexes. Guided by the law on “Setting a Procedure for Cadastral Valuation of Real Estate Close to Market Value for Tax Purposes on Real Estate,” Articles 2 and 5 of the Civil Code, point 2 of the procedure established by the Government of the Republic of Armenia on May 18, 2006, N731-N, and point 33 of the procedure approved by the Government of the Republic of Armenia on May 18, 2006, N912-N, and considering the professional conclusion provided by the Yerevan Municipality's Department of Architecture and Urban Planning dated May 31, 2024, and the applications of the individual who constructed the structure through a representative (October 27, 2023, No. D-132660-23, May 20, 2024, No. D-64603-24).
1. The self-built structure, with a total area of 47.57 square meters (based on the measurement provided by “KANON AREA” LLC), located at 27/2 Gulbenkian Street, which is owned by the city of Yerevan, is recognized as legal (attached are the plots and building layouts).
2. The structure and land specified in point 1 of this decision are offered for direct sale to the person who completed the construction, Armen Ashoti Grigoryan (passport AX0289820, issued by 007 on June 6, 2024, born December 19, 1982), with a right of first refusal.
3. The head of the Department of Architecture and Urban Planning of the Yerevan Municipality, Hayk Muradyan, is authorized to sign a sales contract for the immovable property with the Buyer on behalf of the Mayor of Yerevan within a 30-day period after receiving the written notice-extract from the financial department of the staff, certifying the fact of the payment by the individual who completed the structure for the legalization of the structure and the allocated land specified in point 1 of this decision.
4. This decision may be appealed administratively to the Mayor of Yerevan or judicially to the administrative court of the Republic of Armenia within two months from the date it comes into force.
5. The supervision of the execution of this decision is assigned to the Secretary of the Yerevan Municipality staff.
