Navalny's Body Should Be Returned to His Family, Lawyer Says
Alexei Navalny's body should be returned to his family. This was stated in an interview with Ura.ru by Evgeny Kharalamov, an honorary lawyer of Russia and former head of the criminal police department of the Moscow region's internal affairs administration.
The Constitutional Court of the Russian Federation has ruled that it is legal not to return the bodies of terrorists to their relatives (Note: Navalny is included in the list of terrorists and extremists by Rosfinmonitoring). This practice is in accordance with Article 55, which allows for temporary restrictions on citizens' rights and freedoms in order to protect constitutional order and morality.
As the release of bodies may pose a threat to public safety, it could incite mass clashes and lead to new casualties, while burial sites of terrorists may become objects of worship.
“I have never heard, read, or seen anyone recognize him as a terrorist. As we know, he has not been convicted for that, nor has he faced criminal liability for terrorism. Therefore, this question cannot even be raised,” Kharalamov said. “In my opinion, there are no legal or criminal grounds for not releasing the body of a deceased person who died in pre-trial detention or a work colony.”
