SCS Tightens Declaration Rules for Goods Moving from EAEU to Armenia
The State Revenue Committee (SRC) is tightening the declaration rules for goods moving from the Eurasian Economic Union (EAEU) to Armenia. This was reported by the SRC's press service.
It was noted that until now, in cases of uncovering inaccurate information in transit declarations for goods transported from the EAEU, Article 316, Part 1 of Armenia's Law on Customs Regulation has been applied, allowing for administrative responsibility in the form of a "warning," and the goods were considered to have a union product status.
This approach has led to a relaxation of discipline among those transporting the relevant goods and has created opportunities for potential abuses.
From now on, in administrative proceedings regarding cases of uncovering inaccurate information in transit declarations for goods coming from the EAEU, the SRC will implement the following approaches:
- Goods will not be recognized as union products if they have been unloaded, transshipped (reloaded), or any other freight operations have been performed on the territory of a non-member state without the permission of the customs authority. This also applies if the transporting vehicle has been replaced, except in cases where these actions were due to an accident or force majeure.
- If imported goods from a member state do not match what was declared in the transit declaration (for example, if goods differ from those declared or if there are undeclared goods, or if the weight or quantity of the imported goods exceeds the declared weight or quantity, etc.) leading to the absence of a declaration formed through a "customs transit" procedure, such goods will not be considered to have union product status. Consequently, in such situations, they will be subject to registration as goods from a third country. If they are not registered as goods from a third country in the prescribed manner, they will be subject to restrictions.
At the same time, the committee informs that during the administrative proceedings, the economic operator will not be deprived of the opportunity to present other evidence regarding the product's union status, which will be properly assessed by the State Revenue Committee of Armenia.
