According to the Constitutional Court's ruling, Levon Kocharyan must be released immediately. Essentially, based on the Constitutional Court's decision, the preventive measure is already considered lifted. The prosecutor's decision regarding the lifting of the preventive measure is not necessary since the Constitutional Court's decision implies the a priori lifting of the measure. The Constitutional Court's ruling also indicates that it is mandatory for all institutions, including the penitentiary. The penitentiary, as another state body, must also independently carry out the Constitutional Court's decision," he said.

When asked whether Levon Kocharyan is using his mandate to be released from detention, the lawyer considered the question "inappropriate."
