Yerevan Municipality Officials Illegally Alienate Land on Khorenatsi Street
Yerevan's land located on Khorenatsi Street has been alienated by officials of the Yerevan Municipality in violation of the law. A criminal case has been initiated based on the prosecutor’s report, as stated by the Prosecutor General’s Office of Armenia.
It has been established that the officials granted a land plot of 2707 square meters to the 'Byurakn' LLC for the purpose of constructing a hotel complex at the intersection of Khorenatsi Street and the first cul-de-sac of the same street. This action contravened Article 66, Clause 1, Sub-clause 4 of the Land Code.
“The signed lease agreement stipulated a mandatory condition that, upon fulfillment of contractual obligations, the land would be sold to the lessee with a preferential right of purchase. However, without the fulfillment of conditions and the construction of the hotel complex, the lessee was unjustly granted the right of preferential purchase, and the land was sold directly to 'Byurakn' LLC on October 27, 2006,” the report states.
Moreover, the officials of the Yerevan Municipality did not take actions to terminate the rights over the land through compulsory procedures three years after the expiration of the construction permit, as well as after the date of granting the land for development, which resulted in significant harm to the legal interests of the state (community).
In relation to the apparent crime committed by the officials, the prosecutor has reported the crime to the Anti-Corruption Committee. On October 4, 2023, a criminal case was initiated at the Anti-Corruption Committee under Part 1 of Article 308 and Part 1 of Article 315 of the Criminal Code of Armenia.
