A Warning Has Been Issued to the Military Prosecutor of the Sevan Garrison

The Chief Prosecutor of the Republic of Armenia, Anna Vardapetyan, has issued a "warning" disciplinary sanction to the military prosecutor of the Sevan garrison. This information was reported by the Office of the Chief Prosecutor.

"The basis for the sanction was the fact that an autonomous official in the Sevan garrison military prosecutor's office engaged in negotiations with the accused of a minor crime and their defense attorney within the framework of the agreement procedure. As a result, a punishment of imprisonment was imposed on the accused.

This agreement was reached even though the person who committed a minor crime for the first time cannot be sentenced to imprisonment (Article 67, Part 5 of the RA Penal Code)," the statement reads.

In turn, the first instance court of general jurisdiction in Gegharkunik marz, ignoring the aforementioned legal requirement, and in violation of Article 461, Part 3 of the RA Criminal Procedure Code (which addresses failure to perform mandatory military or alternative service or evading conscription during a state of martial law or war) accepted the agreement protocol, ruling a sentence of 6 months imprisonment, which, without conditional application, established a probation period of 1 year.
