Judge Arusyak Aleksanyan's Indictment Submitted to Anti-Corruption Court
The investigatory department of the National Security Service has uncovered factual data indicating that an official of the judicial authority, aware of a court ruling regarding the detention of a defendant being represented by a close friend, who is a lawyer from the Chamber of Advocates, aimed to carry out illegal actions for the benefit of the aforementioned individual. This involved reaching an obviously unjust court ruling to release him from detention.
With the intent to achieve his criminal purpose, the judge entered into preliminary agreement with his assistant—an official—and an unidentified official from the office of the General Jurisdiction Court of Yerevan, assisted by his close lawyer. He acted beyond his exclusive powers of judicial authority, resulting in serious consequences through negligence. Moreover, with the help of his assistant, he rendered an obviously unjust court ruling, substituting the detention measure applied to the defendant with a bail.
The supervising prosecutor has decided to initiate public criminal prosecution against the official of the judicial authority for the committed offenses. The judge, the judge's assistant, and the lawyer have been charged. The General Jurisdiction Court of Yerevan ruled to apply detention as a measure of restraint against the official of the judicial authority. By a decision of the prosecuting body, the part of the criminal proceedings regarding the aforementioned defendants has been separated into an individual case, which has been submitted to the Office of the General Prosecutor of the Republic of Armenia with an indictment conclusion.
On January 3, 2023, the indictment was confirmed by the supervising prosecutor's decision and submitted to the Anti-Corruption Court of the Republic of Armenia along with the materials of the criminal case.
