Judge Can Contract Coronavirus: Supreme Judicial Council Will Not Hold Judge Disciplinary Responsible
The Administrative Court judge Daniel Danielyan will not be subjected to disciplinary responsibility for not personally delivering a judicial act during a session due to being infected with the coronavirus. According to a report by Factinfo, the Supreme Judicial Council, presided over by Sergey Chichoyan, rejected the motion to hold Judge Daniel Danielyan accountable.
It is reminded that a disciplinary proceeding was initiated against Judge Danielyan based on a report by the Minister of Justice of the Republic of Armenia regarding the President of the 'Enlightened Armenia' party, on the grounds that the ruling in this case was read out loud (published) during the court session not by the presiding judge Danielyan, but by another judge included in the collegial judicial composition. Subsequently, when Judge Danielyan presented an explanation to the Minister of Justice on January 26, 2022, stating that the Administrative Procedure Code of the Republic of Armenia only stipulates that the judicial act resolving the case must be read out loud (published) in the court session, but does not specify which specific judge among the collegial composition should deliver it, and also considering that this cannot violate any person's rights, the Minister of Justice made a decision the following day, January 27, 2022, to apply to the Supreme Judicial Council regarding the disciplinary responsibility of Judge Danielyan.
