Requests of Kocharian's Defenders Denied

The Court of Appeal, presided over by Judge Narine Hovakimyan, rejected the prosecution's request to appeal to the Constitutional Court regarding the alleged overthrow of the constitutional order and to suspend the criminal proceedings in this case, thereby leaving unchanged the decision of the first instance general jurisdiction court of Yerevan.

Prosecutor Gevorg Baghdasaryan referenced a ruling by the European Court of Human Rights concerning an application by the "Dareskizb" LLC, owned by Nikol Pashinyan's family. According to the prosecutor, this decision could serve as a new basis for the Court of Appeal to address the Constitutional Court.

The court also denied requests from former President Robert Kocharian's defenders and representatives of the victim's side.

The decision can be appealed to the Court of Cassation within a one-month period from its receipt.

It should be noted that the general jurisdiction court of Yerevan, presided over by Judge Anna Danibekyan, had previously acquitted former President Robert Kocharian, former Deputy Prime Minister Armen Gevorgyan, former Minister of Defense Seyran Ohanyan, and former Chief of the General Staff Yuri Khachaturov on April 6, based on the Constitutional Court's ruling recognizing Article 300.1 of the Criminal Code as unconstitutional, terminating criminal prosecution against them due to the absence of a criminal act.
